1. About these terms
These terms apply when a client engages Post Studio for commercial photography, event photography, unit stills, behind-the-scenes coverage, stage photography, retouching or related visual services. The agreement consists of the accepted quote or scope, these terms and any written variations agreed by both parties. If there is an inconsistency, the accepted project-specific document takes priority.
2. Quotes and booking
A quote is based on the information available when it is issued, including dates, locations, hours, deliverables, production requirements and intended image usage. A booking is confirmed when the client accepts the quote in writing and pays any booking fee or deposit stated in it. Dates may remain available to other clients until confirmation is complete.
3. Fees and payment
Fees, payment stages, expenses and due dates are stated in the quote. Additional time, travel, equipment, assistants, studio hire, permits, parking, freight, specialist retouching or changed usage may be charged when they fall outside the accepted scope. Post Studio will obtain approval before undertaking material additional work where reasonably practicable. Final files may be withheld until overdue amounts are paid, subject to rights that cannot lawfully be excluded.
4. Client responsibilities
The client must provide accurate briefing information, safe and timely access, relevant schedules and contacts, and any brand, publicity or technical requirements needed for the project. Unless otherwise agreed, the client is responsible for venue permissions, filming or photography permissions, talent and property releases, permits and ensuring that people responsible for the location or production know photography will occur.
5. Schedule changes and delays
The client should notify Post Studio promptly of changes to dates, locations, access or running times. Waiting time, overtime or additional attendance caused by delays outside Post Studio’s control may be charged at the rate stated in the quote or, if no rate is stated, at a reasonable rate agreed before the additional work proceeds where practicable.
6. Cancellation and rescheduling
Cancellation and rescheduling charges depend on notice, committed production costs and the ability to rebook the reserved time. The applicable arrangement will be stated in the quote. Post Studio may retain or recover reasonable amounts for work already performed and non-recoverable costs, but these terms do not remove any refund, remedy or cancellation right available under Australian law.
7. Weather and circumstances beyond control
If unsafe weather, venue restrictions, illness, transport disruption, government action, equipment failure despite reasonable care or another event beyond reasonable control prevents performance, the parties will try in good faith to reschedule or agree an alternative. Neither party is responsible for delay caused by such an event to the extent permitted by law, but completed work and unavoidable third-party costs remain payable where appropriate.
8. Creative approach and coverage
The client acknowledges Post Studio’s documentary-led visual style and grants reasonable creative discretion over framing, timing, lighting, selection and editing, subject to the agreed brief. No specific image can be guaranteed where access, performance, weather, lighting, safety, production instructions or events outside the photographer’s control prevent it. Post Studio will use professional judgment to produce a useful and coherent body of work.
9. Image selection and editing
Post Studio selects the photographs that meet the brief and quality standard. Finished images normally include colour correction, tonal adjustment, cropping and consistent finishing. Extensive compositing, object removal, beauty retouching, key art or other specialist work is included only when stated in the quote. Unselected captures and RAW working files are not standard deliverables unless agreed in writing.
10. Delivery and archiving
The expected delivery method and timing are confirmed for each project. Delivery dates may change if the scope changes, feedback is delayed or circumstances outside reasonable control intervene. Clients should download and securely back up delivered files promptly. Post Studio takes reasonable care of project files but does not guarantee indefinite storage after final delivery unless archive services are expressly included.
11. Copyright and client licence
Except where copyright is assigned by a written agreement or the law provides otherwise, copyright in photographs and other created material remains with Post Studio. Once the agreed fees are paid, the client receives the licence described in the quote. The licence may specify media, territory, duration, campaign, exclusivity and permitted users. Uses outside that licence, including third-party advertising, resale, sublicensing, stock use or transfer to unrelated organisations, require prior written approval and may attract an additional fee.
12. Credits, alterations and AI use
Where a credit is practical and agreed, it should identify Post Studio or Ilya Postnikov. Images must not be materially altered, composited, filtered or used in a misleading context beyond normal layout and cropping without approval. Training generative-AI systems, creating synthetic derivatives, face replacement or licensing images to AI datasets is not included unless expressly agreed in writing.
13. Portfolio and publicity
Post Studio may request permission to display selected work in its website, portfolio, awards, social channels or self-promotion. Confidential productions, embargoed campaigns and sensitive assignments will not be published contrary to an agreed restriction. A client may request confidentiality or an embargo before booking so it can be reflected in the scope and fee.
14. Privacy and personal information
Contact, booking and project information is used to prepare quotes, provide services, communicate with clients, maintain records and meet legal obligations. Identifiable photographs may constitute personal information in some circumstances. Each party must handle personal information, releases, notices and publication permissions relevant to its role and comply with applicable privacy obligations.
15. Safety and conduct
Post Studio may pause or stop work where conditions are unsafe, unlawful, abusive or materially different from the agreed environment. The client is responsible for communicating site hazards, inductions, access rules and required protective equipment in advance. Reasonable directions from venue, production and safety personnel will be followed.
16. Problems with the services
The client should notify Post Studio promptly and provide reasonable detail if it believes the services or files do not match the agreement. Post Studio will assess the issue and, where appropriate, correct files, repeat affected work, provide another remedy agreed by the parties or provide a remedy required by law.
17. Liability and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded. To the extent the law permits liability to be limited, liability will be limited to resupplying the relevant services or paying the reasonable cost of having them supplied again. Neither party is liable for indirect or consequential loss to the extent such exclusion is lawful.
18. Governing law
These terms are governed by the laws of Queensland, Australia. Before starting formal proceedings, the parties will try in good faith to resolve a dispute through direct discussion. This does not prevent either party seeking urgent relief or using a consumer-protection process available to it.
